As the mattress sales wrap up from Presidents' Day, I thought it might be valuable to pause and reflect on this little-known gift from the first president. Apparently, in his youth, Washington was assigned a penmanship exercise of copying the rules of civility as drafted by others before him, and perhaps he editorialized in that process. Everyone likes to think that a 16-year-old Washington wrote these rules, but I think it is more likely that they were associated with Jesuits hundreds of years earlier. I've always felt a special connection to George Washington, having grown up on property that was once his farm, part of his Mount Vernon estate. In this lengthy article, I have rewritten these rules of civility to apply to courtroom presentation, persuasion, jury consulting, courtroom technology, and general decorum for the trial lawyer. My general disposition as a litigation consultant is to win at all costs, so many of these rules are also aspirational. Unless the original rule fits, I am presenting my courtroom-translated rule, followed by the original rule. "George Washington's" 110 Trial Lawyer Rules of Civility 1. Every action done in the courtroom ought to be with some sign of respect to those who are present. That especially means not reading bullet points to your judge or juror. It wastes their time. Mastering courtroom presentations involves more than just knowing the law; it requires understanding how to engage your audience without overwhelming them. This can be especially problematic in a courtroom as jurors and judges are tasked with understanding complex legal arguments and evidence, which often involve intricate details and nuanced interpretations. When attention is split between spoken words and litigation graphics, such as PowerPoint slides, charts, or physical evidence, the likelihood of misunderstanding or missing critical information increases significantly. I often talk about what not to do, but sometimes, I must remember to mention what you should do to achieve success at trial. In honor of leap year 2024, I have written this article offering 29 tips for successful trial preparation and execution. You can use this list as a checklist to compare yourself to your peers. I did not develop these ideas alone. Instead, they come from my experience working with the best of you over the past 30 years. 1. Conduct a mock trial. The very best litigators always conduct a mock trial when at least $10 million is at stake. Mock trials are a critical part of the Persuadius service offerings. Only three people, including me, see those. 2. Conduct more than one mock trial. The ideal number is three, and that's precisely what I have observed the best trial lawyers do. It's not always affordable, but more than one mock is mandatory for cases with $25 million or more at stake. The only thing that varies is the investment in each mock trial. If $100 million or more is at stake, every mock should have every investment possible (i.e., a proper mock facility, a two-day or three-day mock, live witnesses, opening and closing statements, etc.). 3. Collaborate with litigation consultants who bring experience and insights to trial preparation. With a track record of handling hundreds of trials, we have witnessed exceptional and lackluster attorney performances. We aim to share valuable knowledge and advice, not lecture or boast about expertise. Drawing on the collective wisdom of countless cases, we strive to support you in crafting a solid and effective trial strategy. Litigation consultants can be exceptionally helpful when developing your opening statement. 4. Build a solid opening statement. In 30 years, I haven't seen anything to convince me that the opening statement is not the most essential part of the case. Some studies say that 80% of jurors make a decision about who will win after hearing opening statements. When done correctly, it should take months to develop an opening. We don't have a Hippocratic oath (i.e. do no harm) in the legal field, but when it comes to using litigation graphics at trial, maybe we should. You see there are some times when using litigation graphics does real damage to your overall persuasiveness. It is incorrect to assume that when using visual aids such as demonstrative evidence, scale models, trial boards, computer animation, or the ever-present PowerPoint presentation you are always doing good and helping your audience. Here are seven times when you would be better off changing your approach or not using litigation graphics at all: You are reading from your slides: If you populate your trial presentation with bullet point filled slides and you read them, you are reducing the amount of information your audience will remember and understand. This is due to the redundancy effect or split-attention effect. See Should You Read Documents Out Loud at Trial? You are going to get caught cheating: Creating a chart that is persuasive is great. Creating one that is misleading can cost you your credibility. As one of our customers rightly says in the video below, "Finding ways to illustrate ideas but also to visually display the evidence in a way that's understandable to the jury is critical in order to earn their trust -- which is the most important asset you have." You are not using storytelling in combination with your litigation graphics: All too often trial counsel moves chronologically through a case without considering whether there was a better approach to storytelling. I think timelines can lock us into this approach. Sometimes chronological is best but sometimes using more sophisticated storytelling techniques to persuade work best. In any case, if you fail to tell a story, a jury will make one up to fill the void. Therefore, be sure to combine your visuals with storytelling to win your case. Both experience and the science of persuasion tell us that reading documents to a jury is a persuasion killer. But of course there are times when you absolutely need to read a document out loud. This article will help you find the best ways to do so when it is necessary. There are at least five good reasons why reading documents out loud is harmful. I will go through them, then offer three guidelines for reading passages of text to a jury or judge when it is necessary. After all, it’s hard to imagine trying a contract case without reading the key provisions of the contract. The split-attention effect/redundancy effect is easy to recognize, and we've all experienced it. In summary, if you are presented with a written document and it is read to you at the same time, your brain will have a hard time sorting out whether to read or to listen. What you might not know is that you actually end up far worse off reading written materials while seeing an image of those materials than you would have if you had just done one or the other -- read the materials or listened to the words. The last tip is the use of demonstrative evidence in connection with the statement. You need to be aware that most people, other than lawyers, are visual preference learners. Most lawyers, in contrast, are auditory or kinesthetic preference learners.1 Most people teach the same way they prefer to learn – so lawyers typically teach by lecturing, since that is most comfortable for them. But this strategy does not help with the majority of jurors, who would prefer to be taught visually, at least in part. So bridge this courtroom gap with demonstrative evidence, including litigation graphics.

I notice something about audiences in the PowerPoint presentation era. They seem to get easily disengaged part of the way into a presentation. This tendency is especially problematic in a courtroom setting since judge and juror visual attention is critical for courtroom persuasion.
